Selling Real Estate on Contract vs. Outright Sale
Understanding Your Options in Iowa
What Is an Outright Sale?
The buyer pays for the property in full at closing — either with cash or a bank loan. You receive the full purchase price, the buyer receives the deed and full legal ownership immediately, and the transaction is complete. This is the most common way homes and farmland are sold in Iowa.
What Is Selling on Contract?
Selling on contract (Contract for Deed) means you, as the seller, finance the purchase for the buyer. The buyer makes a down payment and monthly payments directly to you; you keep legal title until the contract is paid in full, at which point you transfer the deed. This method is especially common in rural Iowa when selling to buyers who may have trouble qualifying for traditional bank financing.

| Buyer qualification | Bank financing or cash | Can work without traditional financing |
| Risk if buyer defaults | None | May need legal process to regain possession |
When Selling Outright Might Be Better
- You want the full purchase price immediately
- You want to minimize risk and future involvement
- The buyer can easily qualify for a bank loan
- You want the simplest, fastest exit from the property
When Selling on Contract Might Be Better
- The buyer can't get traditional financing (e.g., a beginning farmer)
- You'd like a steady stream of monthly income
- You're willing to act as the lender for part of the sale
- You want to potentially spread capital gains taxes over several years
- You're selling farmland or acreage to someone in the community
Important Legal Considerations in Iowa
- A well-drafted contract is essential to avoid disputes
- You remain responsible for taxes, insurance, and major repairs until paid in full
- Proper recording of the contract and eventual deed is important
- Tax rules for installment sales can be complex — work with your accountant
